The Higher Duty of Counsel in the United Kingdom

David Wood QC, the Chairman of the Governors of the Inns of Court College of Advocacy, has reminded the international audience at a CIArb Conference in Paris on December 8, 2017 that Counsel’s obligation to help his/her Client to win is overridden by a higher duty to assist the Judge in the proper administration of justice, to draw the tribunal’s attention to all relevant authorities of which he/she be aware and to disclose all documents which he/she knows about, even if they do not support his/her client’s case.

The respect of these rules if fundamental to ensure that the Judge may trust counsel, what in the end is in favor of his/her Client.
