Can I always submit a dispute to arbitration

Arbitration has its basis in the parties’ consent.

To submit a dispute to arbitration, an arbitration agreement or a submission is required and the dispute must be arbitrable.

The condition precedent for having an arbitration is that the parties agree upon it.

This does not mean that if the parties have not inserted an arbitration agreement in their contract (which is usually the case), they cannot have an arbitration. In this event the parties have simply to agree upon an arbitration submission before starting the dispute.
